Article 1 — Object

L’OCCITANE New Zealand (“Organiser”) is organising a marketing game named Let’s Colour Together, running from February 3rd until February 29th, 2020 (“Game Period”) via the Game platform at https://nz.loccitane.com/let-s-color-together,26,1,97791,1462824.htm (“Game Platform”).

1.1 Entry conditions

The Game is open to the New Zealand region. Employees, interns, officers and directors of the Organiser and each of their parent and affiliated companies, suppliers as well as the immediate family (parents, siblings, children, spouses and life partners of each, regardless of where they live) and household members of each such employee, officer, or director (whether related or not) are not eligible to participate in the Game. The Game is void where prohibited by law.

​By participating in the Game, Participants acknowledge and agree to their full acceptance of these Game Rules (the “Rules”).

1.2. Procedure for entry

The Game is free to play. No purchase is required. Eligible Participants may enter into the Game and colour the OMY Fresco elements on the Game Platform (https://nz.loccitane.com/let-s-color-together,26,1,97791,1462824.htm)

The prizes are in the form of "Promo Codes" that have been randomly distributed behind OMY Fresco elements, to be discovered when colouring is completed.

Entering the Game indicates a Participant’s full and absolute acceptance of all provisions of the Rules and the Organiser’s privacy policy.

Any entries that are incomplete or inaccurate, or that do not follow the procedure set out above shall not be considered and so shall invalidate the entry.

Article 2— Prize

The Prize is in the form of promo codes that will appear while colouring the fresco and you can easily redeem on L'Occitane NZ website https://nz.loccitane.com/ before checkout

Up to 50 Prizes will be awarded randomly each day during the Game Period. Odds of winning a Prize depend on the number of participants during the Game Period.

The Participants undertake and agree that neither the Prize nor any of its components may be returned or exchanged. The Prize has no cash value and it can be redeemed online only.

The Organiser reserves the right to replace any Prize with another prize of equivalent value and characteristics for any reason in its sole discretion, without incurring liability in this regard.

Article 3 —Limitation of liability

Entering the Game constitutes Participants’ unqualified acceptance of all provisions of the Rules in their entirety. By participating in the Game, Participants agree, to the fullest extent permitted by law, to release and hold harmless Organiser, and its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Game. Organiser assumes no responsibility or liability for the following: (i) telephone or technical malfunctions that may occur; (ii) any incorrect or inaccurate information, any of the equipment or programming associated with the Game, or any technical or human error that may occur in connection with the Game; (iii) any injury or damage to participants or their property related to or resulting from participating in the Game; (iv) the destruction of information provided by Participants for reasons not attributable to the Organiser; or (v) inaccessibility or unavailability of the Internet or any combination thereof.

Entering the Game implies familiarity with, and acceptance of, the characteristics and limits of the Internet, in particular as regards technical performance, response times for consulting, examining or transferring information, risks of interruption and, in more general terms, the risks inherent in any connection to, and transmission via, the Internet, the lack of protection for certain data against any breaches and risks of contamination by any Internet viruses.

The Organiser may not be held liable in the event of the malfunctioning of the Internet, or of the preventing access to, or satisfactory running of, the Game. In particular, the Organiser may not be held liable for any external malicious acts.

While the Organiser is doing all it can to provide users with information and/or resources that are available and verified, it may not, however, be held liable for any errors (in particular as regards displays on the Game sites, errors in emails), for unavailability of information and/or for the presence of viruses on the site.

It is up to each Participant to take all appropriate steps in order to protect his or her own data and/or software stored on his or her computer and telephone equipment against any attacks. Any individual accessing the Game Platform does so under his or her sole responsibility.

If, for any reason, the Game is not capable of running as planned, including because of, tampering, unauthorised intervention, fraud, technical failures, force majeure, or any other cause beyond the control of Organiser that may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, Organiser reserves the right, in its sole discretion, to rescind, cancel, terminate, modify or suspend the Game. Any instances of fraud or of failure to obey the Rules may lead to the party responsible being disqualified from the Game, and the Organiser reserves the right, if appropriate, to take legal action against the said party.

Article 4 — Access to, and interpretation of, the Rules - modifications

4.1 Access

The Rules may be viewed in their entirety on the Organiser’s website https://nz.loccitane.com. Any inquiries must be set out in writing and received by the Organiser at the address loccitane@xtra.co.nz prior to February 29, 2020.

4.2 Interpretation of the Rules

Any questions relating to application or interpretation of the Rules and any unexpected questions that may arise shall be resolved by the Organiser in its sole and absolute discretion.

4.3 Modifications

The Organiser reserves the right to extend, curtail, modify or cancel the Game at any time, and in particular in the event of an occurrence of force majeure, without the Participants being entitled to claim any compensation or any unearned Prizes as of the effective date of the termination.

Any modifications shall be set out in an amendment posted on the Game Platform.
